Renowned International Law Experts Recommend International Criminal Court (ICC), if Sri Lanka continues to Fail to Act

In a Press Conference held in Geneva within hours of Sri Lankan Foreign Minister Mangala Smaraweera’s address to the UN Human Rights Council, a group of well renowned international Law experts recommended Sri Lanka be referred International Criminal Court (ICC), ”if Sri Lanka continues in bad faith and/or fail to take significant steps towards implementing the word and spirit of the UN Human Rights Council Resolution 30/1, including establishing a hybrid war crimes court with the participation of international judges and prosecutors.”

The group Monitoring and Accountability Panel (MAP), was established to monitor Sri Lanka’s compliance to the UN Human Rights Council Resolution 30/1, which Sri Lanka itself co-sponsored.

Based on the documented events of the last twelve months, the MAP has come to the following conclusions:

1) The Government of Sri Lanka is not acting in good faith with respect to its commitments under the UN Human Rights Council Resolution 30/1;

2) Human Rights violations and abuses amounting to crimes under international law continue to be committed in Sri Lanka with impunity;

3) Key reforms to the country’s justice and security sectors have failed to materialize; and

4) The initial reaction of the Government of Sri Lanka to the Final Report of the Consultation Task Force on Reconciliation (CTF) appointed by the Sri Lankan Government itself amounts to a cynical and reckless repudiation of the stated aspirations of Sri Lanka’s citizens.

Ottawa Farmer Appeals Raw Milk “Cease and Desist” Order

OTTAWA, ONTARIO, CANADA, February 27, 2017 /EINPresswire.com/ — Ottawa-area farmer Michael Ilgert is the current target of government action to curb raw milk sales. In December of 2016, Renfrew County and District Health Unit ordered Ilgert to “cease and desist from selling, offering for sale and distributing, milk that is not pasteurized.” Ilgert is now entering an appeal of the order to the Health Services Appeal and Review Board. A hearing is scheduled for Tuesday, February 28, 2017 at 10 am in the Indigo Room at the Metcalfe Hotel, 123 Metcalf Street, Ottawa, Ontario, K1P 5L9.

UN Human Rights Council: UK to Support Sri Lanka Despite "Rape Camp" Allegations?

UK urged by victims groups to help bring Sri Lanka to UN General Assembly for International Criminal Court (ICC) Referral, like North Korea.

As the UN Human Rights Council begins its Session on Mach 27th in Geneva, there are reports that United Kingdom is planning to support Sri Lankan Government at the Council from facing UN inquiry, despite a recent report by the International Truth and Justice Project (ITJP) about Sri Lankan Military run "rape Camps", where Tamil women are being held as sex slaves.

According to the report:

"A senior officer came into the room and was asked to take his pick, like we were meat in a meat market. He looked around and chose me. He took me to another room and raped me"

"Two of the women describe being detained in a group in one room, available for any soldier to come and chose from and take to an adjacent room or tent to be raped," says ITJP.

48 of the victims had been detained under the Government of former President Mahinda Rajapaksa and 7 of them under the new Government of President Maithripala Sirisena.

ITJP has also provided details of six military men including a major and a leiutenant colonel who are alleged perpetrators of rape and torture in the military.

UN HUMAN RIGHTS COUNCIL RESOLUTION ON SRI LANKA

According to UN Internal Review Report on Sri Lanka around 70 thousand Tamils were killed in six months in 2009 and Tamil women were sexually assaulted and raped by Sri Lankan Security forces which have committed war crimes and crimes against humanity.

To address these issues, numerous resolutions on Sri Lanka were passed in UN Human Rights Council (UNHRC) since the war ended, seven years ago. Time and space in good faith with encouragement were given to Sri Lanka to implement UN Resolutions but no concrete actions were taken by both the previous and the present government. Victim groups have accused Sri Lankan government of deliberately delaying actions without any justification.

There are reports that UK is inclined towards supporting Sri Lankan Government's request to a Roll – over Resolution with extension of time, literally bailing-out Sri Lanka from being hauled before International Criminal Court (ICC).

British Civil Society groups have initiated an on-line campaign to urge UK Prime Minister Theresa May to take appropriate steps at the UN Human Rights Council, in March 2017 to Refer Sri Lanka to the UN General Assembly for International Criminal Court (ICC) Referral, like North Korea.

அரசியல் மனத்திட்பமின்மை:

எத்தனை ஆண்டுகள் கால நீட்டிப்புத் தந்தாலும் பயனேதும் விளையாது. ஏனென்றால் தமிழர்களுக்கு எதிராக அப்பட்டமான உரிமை மீறல் செய்தவர்களை அக்குற்றங்களுக்குப் பொறுப்பாக்கும் அரசியல் மனத் திட்பமேதும் அடுத்தடுத்த சிறிலங்கா ஆட்சியாளர்களுக்கு இல்லை.

அரசாங்கத் தலைவர்களின் குட்டிக்கரணம்:

தமிழர்களுக்கு எதிரான வன்கொடுமைகள் நிகழ்த்தப்பட்ட போது தளபதியாகச் செயல்பட்டுப் படையினருக்குக் கட்டளைகள் பிறப்பித்த ஜெனரல் சரத் பொன்சேகாவை இப்போதைய சிறிலங்கா அரசாங்கம் தனது அமைச்சரவையில் சேர்த்து, அவருக்கு உயர்ந்தபட்ச படைத்துறை விருதாகிய ஃபீல்டு மார்சல் பட்டமும் கொடுத்திருப்பது ஐநா மனித உரிமை மன்றத்தை அவமதிக்கும் செயலாகும்.

அதிபர் சிறிசேனாவும் தலைமையமைச்சர் விக்கிரமசிங்காவும் அவர்தம் அமைச்சர் பெருமக்களும் தனித்தனியாகவும் ஒன்றாகச் சேர்ந்தும் வெவ்வேறு சந்தர்ப்பங்களில், அரசுக்குச் சொந்தமான ஊடகங்களுக்கு அளித்த செவ்விகளிலும் பொது மேடைகளிலிருந்து ஆற்றிய உரைகளிலும், ஐநா மனித உரிமை மன்றத் தீர்மானத்தின் முதன்மைக் கூறுகளை மறுதலித்துள்ளனர்.

அரியணைக்குப் பின்னிருக்கும் ஆற்றல்களில் ஒருவரான முன்னாள் அதிபர் சந்திரிகா குமாரதுங்கா அண்மையில் செய்தித்தாளுக்கு அளித்த ஒரு பேட்டியில் அரசாங்கத்தின் திட்டத்தை அனிச்சையாகப் போட்டு உடைத்து விட்டார். புதிய அரசமைப்புச் சட்டம் இயற்றப்படுவதோடும், காணாமற்போனோர் அலுவலகம் அமைப்பதோடும் “போர்க் குற்றங்களை விசாரிக்க நீதிமன்றங்கள் அமைக்கத் தேவையே இருக்காது” என்று அப்பட்டமாகச் சொல்லியிருக்கிறார். According to UN Internal Review Report on Sri Lanka around 70 thousand Tamils were killed in six months in 2009 and Tamil women were sexually assaulted and raped by Sri Lankan Security forces and have committed war crimes and crimes against humanity.

To address these issues, numerous resolutions on Sri Lanka were passed in UN Human Rights Council (UNHRC) since the war ended, seven years ago. Time and space in good faith with encouragement were given to Sri Lanka to implement UN Resolutions and its own LLRC report, but no concrete actions were taken by both the previous and the present government. Sri Lankan government is deliberately delaying without any justification. It has no political will to do so.

Britain co-sponsored UNHRC 30/1 the resolution on Sri Lanka on 01/10/2015 and have a crucial role to play to ensure that justice is done for the mass killing of Tamils and sexually assaulting and raping Tamil women by Sri Lankan Security forces.

UK should not sponsor or support a roll-over Resolution with an extension of time, as requested by the Sri Lankan Government. This call by the Sri Lankan Government is to buy time to deviate the international community from its attention on Sri Lanka and to continue its abuses.

This Petition request The Right Honorable Theresa May Prime Minister of the United Kingdom to take appropriate steps at the UN Human Rights Council, in March 2017 by Referring Sri Lanka to the UN General Assembly like North Korea.

REQUESTS:

1) We urge you not to give any extension of time to the Sri Lankan Government to fulfill its commitment to the UN Human Rights Council Resolution 30/1 on accountability beyond its March 2017 deadline. Sri Lanka voluntarily co-sponsored this Resolution and committed to fully implement the requirements of the Resolution by March 2017. Extensions and grace periods have been given already, but no progress has been made on any front,
2) The only way to protect Tamils and give justice and safety is for the UN Human Rights Council to refer Sri Lanka to the UN General Assembly, along with a recommendation to the UN Security Council that Sri Lanka be referred to the International Criminal Court (ICC) or that an ad-hoc International Criminal Tribunal be created on Sri Lanka, similar to the procedure followed to assure accountability for North Korea’s Crimes Against Humanity.

TAMIL’s SAFETY WILL BE IN DANGER:

We fear that any extension of time will embolden and encourage Sri Lankan Government to commit human rights abuses against Tamils without any fear and Tamils safety will be in danger. Tens of thousands Sri Lankan Security forces who committed mass killings and sexual violence are still stationed in Tamil areas and live among the victims. There are numerous reports of current abuses against Tamils, including a recent report by UN Special Rapporteur on torture, cruel, inhuman or degrading treatment or punishment Mr. Juan Mendez.

BACKGROUND:

Creating an international mechanism to prosecute war crimes has been the fervent wish and aspiration of the Tamils ever since the war ended in 2009. The Resolution passed by the UN Human Rights Council in 2015 gave a glimmer of hope that their wishes and aspirations would be fulfilled.

However, we observed with alarm and concern the attempts made by the Government of Sri Lanka and its leaders reneging on their own commitments incorporated in the Resolution which they co-sponsored. It is obvious that there is nothing ambiguous about the Government’s strategies vis-à-vis the Geneva Resolutions. In its attempt to mislead and deceive the international community over and over again, Sri Lanka seeks to further delay the process, thus escaping from accountability for the mass killing and sexual violence of Tamils in 2009 in Mullivaikal, where according to the UN Internal Review report on Sri Lanka around 70 thousand Tamils were killed in six months.

After co-sponsoring the Geneva Resolution and agreeing to the creation of court comprising foreign and local jurists to investigate war crimes, Sri Lankan leaders have been acting contrary to the letter and spirit of the Resolution and their maneuvers are designed to frustrate and defeat the UNHRC process.

As Sri Lanka has accomplished almost none of the commitments it voluntarily made in 2015 to the UN Human Rights Council, any extension of time given to Sri Lanka beyond March 2017 will result in no accountability for war crimes and crimes against humanity it committed against Tamils.

NO POLITICAL WILL:

Any number of years of extension will not yield any results, because there is no political will by successive Sri Lankan Governments to hold those committed gross abuses against Tamils accountable.

VOLTE – FACE BY GOVERNMENT LEADERS:

In an affront to the UN Human Rights Council, the current Sri Lankan Government also made the military chief who commanded the troops during these atrocities, General Sarath Fonseka, a Cabinet member and gave him the highest military honor Field Marshal.

President Sirisena, Prime Minister Wickremasinghe and their Ministers have, individually and in unison rejected main aspects of the Resolution on different occasions, through state-owned media interviews and from public platforms.

Former President Chandrika Kumaratunga one of the powers behind the throne has in her recent press interview, impulsively laid open the government’s plan. She has brazenly said that with the making of a new Constitution, and the establishment of the Office of the Missing Persons, “there would not be any necessity to have courts to probe war crimes” (Daily Mirror, 2nd Feb. 2017).

WILL EMBOLDEN OTHER ABUSIVE COUNTRIES TO COMMIT MASS KILLINGS & SEXUAL VIOLENCE:

The extension of Time to Sri Lanka will also embolden other abusive countries around the world to commit mass killings and sexual violence without any fear and follow Sri Lanka’s example to evade UN Human Right’s Council’s Resolutions.

NORTH KOREA EXAMPLE FOR ACCOUNTABILITY:

In the case of North Korea, North Korea was only accused of committing Crimes against Humanity, but Sri Lanka was accused of committing both War Crimes and Crimes against Humanity.

Documented evidence against Sri Lanka is far more extensive, in-depth, and numerous in comparison to North Korea. Thousands of Tamil victims and witnesses are eager to testify.

Due to North Korea's inaction, the UN Human Rights Council referred North Korea to the UN General Assembly, urging the Assembly to recommend the UN Security Council to refer North Korea to the International Criminal Court (ICC). North Korea is in the UN Security Council’s agenda now.

On 28 February 2017, the Monitoring Accountability Panel (“MAP”) will issue its Second Spot Report, which will coincide with the 34th session of the UN Human Rights Council. In the 27-page report, the MAP’s international legal experts will outline their assessment of the Sri Lankan Government’s transitional justice efforts to date, and provide recommendations going forward.

Since co-sponsoring the UN Human Rights Council Resolution on "Promoting reconciliation" accountability and human rights in Sri Lanka, the Sri Lankan President and Government Ministers have backtracked on their commitments to implement effectively the four transitional justice pillars. In particular, the Sri Lankan Government has reversed its own pledge to include foreign judges and prosecutors in a special war crimes court, and appears intent on ignoring legitimate recommendations of the Consultation Task Force.

Thankfully, there was some measure of justice in this case, but most are being covered-up by Governor Cuomo’s wrongfully named Justice Center which is keeping most reported sexual assault crimes from local police and County elected District Attorney’s. Here is the story followed by another horrific one as well; “New York to pay $3M to family of boy molested at group home” http://www.nydailynews.com/new-york/new-york-pay-3m-family-boy-molested-group-home-article-1.2977392 . The convicted pedophile in this story repeatedly molested a developmentally disabled boy in his care as he worked for New York State. In his own words he said where he worked was "a predator's dream." He also said, "The lack of supervision there made it easy to do what I did," DeProspero said in a handwritten affidavit obtained by The Associated Press. "I could have stayed in that house for years and abused him every day without anybody even noticing at all. It was a predator's dream."
New York State’s system is made up of thousands of State run and privately operated facilities and group homes and the rampant sexual abuse and deaths occurring in these facilities can easily be dramatically reduced, but not if basic prevention measures continue to be ignored. The award winning New York Times “Abused & Used” investigative reporting series http://www.nytimes.com/interactive/nyregion/abused-and-used-series-page.html?_r=0 which was a runner up for a Pulitzer Prize, exposed New York State’s extremely dangerous and deadly system in 2011. Governor Cuomo was already aware of the severe problems because it was brought to his attention many times while he was the NYS Attorney General. Governor Cuomo had every opportunity to right many wrongs and bring about great reforms, but instead he chose to continue to cover-up most of the damages and loss of lives. The very first NY Times investigative report that came out in March of 2011, two months after Cuomo became Governor, details how a sexual predator was caught in the act and that he was still protected and shielded by the State http://www.nytimes.com/2011/03/13/nyregion/13homes.html . Here is the extremely disturbing quote from this investigative report; “At a home upstate in Hudson Falls, two days before Christmas in 2006, an employee discovered her supervisor, Ricky W. Sousie, in the bedroom of a severely disabled, 54-year-old woman. Mr. Sousie, a stocky man with wispy hair, was standing between the woman’s legs. His pants were around his ankles, his hand was on her knee and her diaper was pulled down. The police were called, and semen was found on the victim. But the state did not seek to discipline Mr. Sousie. Instead, it transferred him to work at another home.” Pretty graphic, but this type of evil must come out into the light and dramatic steps must be taken to prevent these horrible sex crimes and rapes of disabled men, women, boys and girls whom are extremely vulnerable and in most cases cannot defend themselves. Bypassing 911 and local police is how New York State currently gets away with covering-up thousands of crimes and deaths annually.
Governor Cuomo has refused to take vital basic emergency actions to protect disabled children and adults from premature death, sexual abuse and rape. You can also take the CNN investigative report titled, “Sick, Dying and Raped in America’s Nursing Homes” http://cnnpressroom.blogs.cnn.com/2017/02/22/sick-dying-and-raped-in-americas-nursing-homes-a-cnn-investigation/ and simply change the words America to New York State and Nursing Homes to Mental Health Facilities and Group Homes, the similarities are almost identical. New York State documents obtained through Freedom of Information Law (FOIL) reveal staggering numbers of deaths and sexual assaults in these facilities. These massive problems cannot continue to be pushed aside and ignored by the Governor of New York State. At the same time this is happening, Governor Cuomo has claimed publicly saying “I am disabled” http://newyork.cbslocal.com/2017/01/29/cuomo-travel-ban-hotline/ which is obviously not true, but he was using it, along with other statements, to say that he is fighting for people with disabilities and their rights, which also sadly not true.
The shear staggering numbers of reported deaths and sexual assaults in these State and private facilities and group homes throughout New York State speak volumes. The truth is, we have severe systemic failures and very ugly things are happening behind these closed doors and many innocent and extremely vulnerable people with disabilities are dying and being raped as a result. State documents reveal that 11-12 deaths on average are reported a day and 1,300 sexual assaults within the Office of People with Developmental Disabilities (OPWDD) system alone on average every year or close to four a day. Most of the deaths are covered-up because Governor Cuomo’s Justice Center is not notifying County elected District Attorney’s and Medical Examiners or Coroners of most of these deaths. It is hard to fathom that they continue to get away with this evil and these crimes as I continue to expose it and shout it from the rooftops, but hopefully it will be stopped soon.
There are basic safety and abuse prevention measures that will make the system much better and safer and dramatically reduce the staggering numbers of deaths and sexual abuse crimes occurring in these facilities, but Governor Cuomo has refused to take action. Surveillance cameras must finally be installed within all mental health facilities and group homes, as well as all transport vehicles, this is vital to prevent these deaths, crimes and to hold sexual predators accountable. Immediate and direct reporting by mandated reporters to 911 and not a State whitewash/cover-up entity is not only critical to hold criminals accountable, but will also save many lives. No longer can New York State continue to deny innocent and extremely vulnerable children and adults with disabilities living outside their family’s home 911 emergency first responder medical and police services and assistance, this is discrimination and in many cases it is deadly. Bypassing local authorities, laws in place for everyone and local courts also denies this specific group of people their 14th Amendment right to “equal protection of laws.”
No longer can Governor Cuomo treat the disabled as sub-human beings denying them their basic rights to 911 emergency services, denying them equal protection of laws and denying them justice.
