PLEASANTVILLE, NEW YORK, USA, October 28, 2019 /EINPresswire.com/ — New York brain injury lawyer, Michael V. Kaplen, is to urge lawmakers to adopt assembly bill A02692, which would prohibit tackling in youth football in the state.

Kaplen, who is a senior partner in New York firm De Caro & Kaplen, LLP, and serves as Chair of the New York State Traumatic Brain Injury Services Coordinating Council, will address the New York State Assembly, Health Committee’s public hearing on Tuesday.

In his statement Kaplen will say that permitting children to engage in tackle football is “equivalent to allowing them to play Russian roulette.”

Kaplen, who has been a vocal advocate of prohibitions on youth tackle football, and maintains a page tracking tackle football legislation on his firm’s website brainlaw.com, will also state that, “Repetitive head trauma in football poses a significant danger. Children who engage in tackle football have a greater risk of sustaining a life-altering brain injury. It is long overdue for us to protect our children’s brains and prevent needless and preventable injuries.”

The hearing is expected to include contributions from medical experts, representatives from youth football organizations, and former NFL players.

And Kaplen will argue that the medical evidence clearly shows that a ban is necessary, “There is only one conclusion to be reached; ‘football is a concussion delivery system’. The Centers for Disease Control repeatedly confirm, ‘a concussion is a brain injury.’”

If adopted, Assemblyman Benedetto’s bill, titled “An act to amend the public health law, in relation to prohibiting children twelve years old and younger from playing tackle Football” would prohibit the playing of organized tackle football for children age twelve and younger in New York State.

The public hearing will take place at 10am Tuesday in New York City.

Joorney nonprofit client The Fresh Project is finding a new way to help Houston homeless population

Organization to help more than a thousand unsheltered Houstonians with dignified, mobile access to showers

HOUSTON, TX, USA, October 28, 2019 /EINPresswire.com/ — Clishe Larke and her partners Abena Opoku and Robyn Birch are on a mission in Houston. The trio have co-founded The Fresh Project in Houston to provide mobile access to sanitary showers for the more than 1,500 unsheltered homeless population of Houston and the hundreds of others who are in and out of shelters.

“I’ve always had a calling to help the homeless and underserved populations in our community,” Larke said. “Homeless individuals who suffer from housing instabilities, mental health and substance abuse need access to essentials that we take for granted, like access to a clean and sanitary shower.”

Larke advocates for homeless alongside co-founders Opoku, a social worker, and Birch, an engineer. Together, the three of them are coming up with a solution that would bring access to a shower to homeless in target areas of Houston through a fabricated mobile shower solution that hooks up to local water supplies. The group would partner with organizations (like local churches or shelters) to offer showers to those in need.

They are launching a fundraising campaign to get toward their goal of raising at least $25,000 for their first mobile shower unit and jumpstart their 501c3 non-profit organization.

“Since organizing, we have learned so much about the Houston homeless population,” Larke said. ‘Along the way, we have met individuals who were once homeless and who see a tremendous need for this offering. They are advocates for us and we’re working directly with them to fundraise and meet with organizations who can help us bring this to life.”

CLEARWATER, FLORIDA, UNITED STATES, October 27, 2019 /EINPresswire.com/ — Involuntary commitment laws are being used to detain mental health patients for profit, with the Citizens Commission on Human Rights (CCHR) saying the system needs to be overhauled and stringent penalties put in place to stem the fraud and abuse. The group applauds the now frequent media coverage of the dangers of commitment laws and patient harm that can ensue, especially in for-profit psychiatric hospitals.

Axios, an online media service, recently featured an article on the issue, headlining it “The dark side of psychiatric hospitals.” It reported: “There are plenty of horror stories about mental health patients caught in abusive or predatory situations.” Lack of government oversight has ensured a lack of accountability; the article points out. Since 2015, CCHR has sent thousands of complaints to legislators across the country asking for increased oversight. [1]

Facilities can exploit patients’ vulnerability in order to drive profits higher, Axios stated. It cited:

• An investigation of North Tampa Behavioral Health, an Acadia-owned psychiatric hospital that “makes huge profits by exploiting patients held under Florida’s mental health law,” the Baker Act, according to the Tampa Bay Times. The facility “uses loopholes in the statute to hold them longer than allowed, running up their bills while they are powerless to fight back.” Hospital charges can be up to $1,500 per night. Keeping patients one additional night can create an additional $1.4 million in annual revenue. [2]

• The Seattle Times reported on 10 private psychiatric hospitals in Washington that have a series of safety issues, and instances of hospitals trying to keep voluntary patients from leaving. [3]

• WXYZ 7 Action News accused the state of Michigan of failing to investigate the suicide deaths of four patients released by Acadia Healthcare’s psychiatric facility StoneCrest Center in Detroit. [4] CCHR adds that the treatment clearly didn’t prevent the four suicides and any investigation should include whether psychotropic drugs or other psychiatric treatments may have contributed to the deaths.

• WPTV Contact 5 in Florida also recently uncovered that two veteran suicides happened within two weeks of each other inside the West Palm Beach VA Medical Center earlier this year, along with one attempted suicide-by-cop. Florida’s Rep. Brian Mast is now asking the Inspector General to investigate. [5]

• The Chicago Tribune reported that a 13-year-old girl was allegedly sexually assaulted by an 18-year-old fellow patient on April 15. Both were residents of Sequel Youth & Family Services psychiatric facility, Northern Illinois Academy in Aurora that treats 6 to 21-year olds. [6]

• Psychiatric facilities have used “telemedicine” to detain patients against their will; one woman visited a facility as a voluntary patient and without her knowledge a “doctor” whom she never saw or spoke with recommended her incarceration and she could not leave.

• WFAA News in Texas reported that a mother took her 11-year-old son to Millwood psychiatric hospital but the boy was detained without her consent. WFAA News detailed: “[T]he door locks behind you. You’re told you can’t leave. Stripped of your clothes, given a new bed. You have no idea when you’ll see your family again.” The facility billed his mother’s insurance company more than $11,000 for the unwanted stay. [7]

Between 2009 and 2012, states cut $5 billion in mental health services but that meant private companies could take over the industry, create creating compelling investment opportunities, and reap the profits—sometimes by 20% to 30%. [8]

This has been a problem for decades. In 1991, The New York Times reported how private psychiatric hospitals had “exploded into a highly profitable $4 billion industry” in the previous five years. It pointed to the civil and criminal investigations into allegations of “improper treatment of patients” and quoted Carl Sherman, a hospital-industry analyst with Dillon, Read & Company, commenting: “The psychiatric hospitals used to be like a kid in the candy store,” said. “They could keep patients as long as they wanted and charge anything they liked.” [9] CCHR says nothing has changed.

Psychiatrist, Dr. John S. Montgomery hit the nail on the head when he told the Times “Our treatment is so much on the side of art rather than science.” [10]

Behavioral health is now a $220 billion-a-year industry. An estimated 10 to 20% of state mental health funds are lost to fraud, waste, and excess profits to for-profit managed care companies—representing $4 billion-$8 billion. [11]

CCHR wants to see regulations that provide better oversight with (1) Greater criminal and civil penalties for violations of patient rights and fraud, including patient safety infringements; (2) Police investigation and prosecution of patient restraint deaths; and (3) Tougher penalties for fraudulent billing practices, including cancellation of federal and state funding and hospital closures for repeated abuse and/or fraud. Elmore is Memphis 1st Independent 35mm Filmmaker who lives in Memphis, Tennessee in a 99.9% Black neighborhood called “Orange Mound. The “Orange Mound to African Initiative is the American story that Connects Black History, Obama and Dr. King.

25 years after 13th Amendment that freed African Americans from Slavery the 1st Neighborhood in America built for African Americans by African Americans emerged in 1890. Orange Mound today is reminiscent of the movie the “Color Purple” Where Mister told Celie you are poor, you Black and you ugly and Celie replied; I'm poor, black, I might even be ugly, but dear God, I'm here. I'm here.” After 130 years we are here however new research shows property values dropped nearly 30% in the “Orange Mound Community.” Assessor Memphis Burgess recently held an “Economic Empowerment Summit to address the declining values in Orange Mound.”

Since 1972 Elmore has been an “Orange Mound Icon” jogging the streets of “Orange Mound.” He won a World Karate/Kickboxing title in 1982 and was the first to bring E.S.P.N. sports network to Memphis. Elmore traveled to Nairobi, Kenya in 1990 to premier his semi-autobiographical movie “The Contemporary Gladiator” whereas Elmore found a treasure in Kenya as to how to make the property values greater in Orange Mound. Elmore created the 1st "All African Home in America" he operated an African Import Store. Elmore want to show African leaders how they can create products for the American market. Elmore plan is called the "Safari Initiative" Safari is an acronym for "Styled African Family Application Renaissance Initiative. Elmore notes we can create the products in Africa and Memphis will be "Africa's Distribution Center. We have meetings with "First Horizon International Banking division.The office Tennessee State Senator Katrina Robinson is working with us as well as other legislators.

In 1979 comedian Richard Pryor visited Kenya and he stopped using the “N” word. President Barack Obama Jr. visited Kenya and penned the book “Dreams of my Father.”

Memphis Congressman Steve Cohen has worked closely with Elmore since he has been in elected to office in 2006. Congressman Cohen wrote a letter to President Obama dated October 15, 2019 that said; “Mr. Elmore has long envision a plan that would make Memphis a hub for cultural exchanges and trade with African Countries. Since the 1990’s he has traveled to Kenya and worked to build relationships with Kenya government officials with the focus of opening exchanges between Kenya and Memphis. Mr. Elmore met with President Daniel Arap Moi in 1992.”

On Wednesday October 30, 2019 African dignitaries from Kenya will arrive in Memphis to not only honor and celebrate Memphis 200 years, the group will honor the legacy of Dr. Martin Luther King Jr. and work to develop “family, culture, economics, trade, religion, education and relationships between Africa and America.” It was noted to Elmore that Kenya President Uhuru Kenyatta would come to Memphis to make this relationship official. Heading the group of Kenyans coming to Memphis is Kenya Presidential advisor professor Peter Nyong’o Governor of Kisumu County the third largest city in Kenya. Kisumu CFO Eric Orangi, Protocol Chief Bob Madanji are scheduled to come to Memphis. Added to the list is Dr. Kodek Migiro Omwancha chief executive officer Lake Region Economic Block., H.E. Hon Wycliffe Ambetsa Oparanya Governor of Kakamega County. H.E. James O Ongwae Governor Kisii County. The Kenya Lake Region Economic Block represents 14 Counties in Kenya. While those in Memphis may not know professor Nyong’o he is the father of academy award winner Lupita Nyong’o.

In 1953 an organization was formed in America called ACOA or American committee on Africa. The groups mission was to fight for the liberation of Africa. In 1956 ACOA sponsored a 26 year old African to come from then British East Africa by the name of Tom Mboya. Tom Mboya is the most influential African to impact American culture, history and politics than any African in history. Without an Mboya there would never have been an Obama. The “Orange Mound to Africa Initiative ” notes “Orange Mound” as the 1st community in America to acknowledge the work of Tom Mboya and its significance and contribution to American culture, history and Politics. Noting that Tom Mboya is the most significant African in American history and Dr. Martin Luther King is the most African American in American history.

The “Orange Mound to Africa Initiative” propose not only the Tom Mboya/Dr. Martin Luther King culture and educational center to be built in Nairobi Kenya. NATIONAL HARBOR, MD, USA, October 25, 2019 /EINPresswire.com/ — This Friday, October 25, inventors from the first ever Patent Protest in US history are returning to rally in support of Emmy & Academy Award winning inventors Glen Sanders and Howard Stark, founders of audio technology company, Zaxcom. Alongside the American Intellectual Property Law Association annual meeting, the U.S. Patent & Trademark Office (USPTO) Patent Trial and Appeal Board (PTAB) will hold a public hearing forcing Zaxcom to defend patents granted to it over the last two decades against competitor Lectrosonics.

Since the creation of the PTAB under the 2011 America Invents Act, 3,173 inventors have had their issued patent rights stripped away. PTAB trials are normally heard within the walls of the US Patent Office in Alexandria, Va. In contrast, this Friday’s hearing will take place in front of 1,000+ lawyers attending the annual convention of the American Intellectual Property Law Association (AIPLA) at the Gaylord National Resort & Convention Center outside of Washington, D.C.

“The USPTO and the AIPLA are representatives of the public-private partnership that is now sadly profiting from the invalidation of the patent rights of inventors,” said Josh Malone, volunteer with US Inventor and inventor/founder, Bunch O Balloons. “Prior PTAB trials were incredibly unjust and devoid of due process, but this week’s gladiator-style show trial is unconscionable. This event has become The Hunger Games for inventors.”

Lectrosonics turned down Zaxcom’s offer of a licensing agreement, opting instead to invalidate the patents through PTAB. This rally is bringing together American inventors from across the country in protest.
