SANTA BARBARA, CALIFORNIA, UNITED STATES, February 26, 2020 /EINPresswire.com/ — The decision in People v Sanchez, the California Supreme Court limits an expert’s ability to rely on hearsay to provide case-specific facts for which a witness has no personal knowledge, as there is no exception to the hearsay exception rule. Although Sanchez was a criminal case, the effect is being felt “big time” in California civil litigation because testimony from life care planners cannot rely on the tenants of life care planning that provides for a systematic means of data collection to be offered as evidence regarding the cost of goods and services for future care, as that evidence is now considered hearsay. The result of Sanchez is that testimony that relies on evidence from pricing databases and calls to vendors for the cost of medical goods and services is being struck by Defendant and Plaintiff attorneys in California as hearsay.

In Verci v. High, et al, an Illinois case, a ruling from the Court of Appeals rejected a life care planner’s testimony that was based on data obtained from the FAIR Health database because the Court found that it is derived from “an unknown number of insurance companies and is used to set reimbursement rates, not to determine the reasonableness of medical charges.”

California Evidence Code requires that an expert base their opinion on their ‘knowledge, skill, experience, education, and training.’ In addition, California Evidence Code allow an expert to ‘state on direct examination the reasons for his opinion, unless precluded by law from using such reasons.’

SANTA BARBARA, CALIFORNIA, UNITED STATES, February 26, 2020 /EINPresswire.com/ — Many jurisdictions across the United States require evidence of a safer alternative design for a medical device known at the time of use for a successful claim in a product liability lawsuit against a manufacturer. In these jurisdictions there may be a Motion for Summary Judgment filed by the manufacturer to have the product liability claim dismissed. Courts have been split whether evidence of a “safer alternative procedure” or untested “safer alternative design” would be accepted by the Court to overcome the Motion for Summary Judgment, thereby allowing a case to go forward.

In Case 1:19-cv-01240-LY-SH the Honorable Lee Yeakel, Austin, Texas, has ruled on this specific issue and ruled that a safer alternative procedure and an untested proposed safer alternative design are each acceptable in allowing the design defect product claim to proceed forward.

In the Austin, Texas case, involving a woman with pudendal neuralgia caused by a Bard Align transobturator sling, Bard argued that there was no evidence offered by the Plaintiff that a safer alternative design existed at the time of implantation that would have prevented or significantly reduced the risk of injury.

Dr. Rosenzweig, an expert for the Plaintiff, testified that there were four safer alternative designs including the following: 1) Burch Procedures, 2) Autologous fascia slings, 3) biological slings, and 4) A sling with less polypropylene such as Ultrapro. Bard argued that Dr. Rosenzweig’s evidence was not sufficient as it offered alternative procedures (not designs) and that Dr. Rosenzweig’s proposed designs have not been demonstrated to be “safer.” Judge Yeakel ruled otherwise.

She was born in a refugee camp in Thailand. Her parents were Vietnamese “boat people” who fled the Communist regime in 1979. Her family later immigrated to New Orleans after a Vietnamese Catholic Church there found a sponsor for them. Once in the U.S., her parents were similar to many immigrants in that they found work in the low-wage service industry. They currently run a convenience store in Louisiana.

Chau’s parents were determined to see her and her brothers graduate from college. For Chau, that was at Boston University. She initially studied creative writing but switched to film studies at her parents’ urging because it was more practical. She had intended to work in documentary film but decided to give acting a try after classmates praised her work in their student films.

What followed were several years of guest starring spots on everything from How I Met Your Mother to NCIS, as well as the 2014 film Inherent Vice from director Paul Thomas Anderson. Chau will receive her Maverick Spirit Award and engage in a conversation about her career on March 7 at the California Theatre in Downtown San Jose following a screening of her new film Driveways.

PARIS, FRANCE, February 26, 2020 /EINPresswire.com/ — The People’s Mojahedin Organization of Iran (PMOI/MEK) released the names of 31 more martyrs of the November 2019 uprising that swept 191 cities across Iran, bringing to 755 the number of those killed, who have been identified so far.

More than 100 days after the uprising, despite domestic and international calls, the Iranian regime, fearing the repercussions of its crime against humanity, continues to refuse announcing the number of those killed. In a despicable game, the regime’s officials and different agencies, including Hassan Rouhani, the Supreme National Security Council, Rouhani’s Spokesman, the Interior Minister, and the Coroner’s Office deflect the announcement of the figures to each other.

In a press conference on February 16, Rouhani said, “The Coroner’s Office has the figures… They can announce it…. There’s no problem with that.” The next day, the Head of the Coroner’s Office responded, “The ratifications of the National Security Council, which is a subsidiary of the Government and is headed by the Interior Minister, have specified as to who must announce the figures… The Government must announce them… We have told the relevant authorities and have no duty to publicly announce them…. You can get all the information from the Interior Minister.”

Subsequently, Rouhani’s Spokesman Ali Rabiee said on February 19, “The figures will be announced by relevant authorities shortly. A decision has been made is this regard and the figures will be announced by one of the authorized entities in the next few days.”

The Iranian Resistance again calls on the United Nations Secretary-General to dispatch a fact-finding mission to Iran to investigate the status of those killed and wounded and visit the prisons and those arrested.

LONDON, ON Canada – “I wonder who is looking at my picture today? I just want to kill myself”, sobs a 13-year old teen who sent a nude of herself to her boyfriend, who circulated the picture throughout their school. Who knows how far it went outside the school?

“I wonder if I will get in trouble for talking so much to that guy on my game? I told him where I live. I know he is a lot older and he sent me nude”, thinks an eight-year old after gaming online with an adult.

“Am I going to be in trouble? I was watching my cartoon online and saw naked adults doing weird things”, wondered a scared six-year old after being exposed to xxx pornography online.

Are children in charge of the Internet? In most cases, yes, they are in charge in their homes. Are you aware of what your child is viewing online? Do you know who is chatting with your child online? Do they know? Are you aware there are young children addicted to pornography? These types of situations, self-exploitation or predation, are becoming an epidemic worldwide.

Do we know how to digitally supervise a child in our care? Son? Daughter? Charlene Doak-Gebauer says this generation is the most independent generation in the history of the world because of the Internet and digital devices. What can be done to assist children as they mature in this digital age?

As a Computer Specialist and Network Administrator in education, Doak-Gebauer has created her user-friendly Theory of Digital Supervision for online child protection. Why is it necessary?

The online vulnerabilities of our children have increased by 10,000% (Thorn) in the past few years because of the Internet and actions of unknowns, knowns, and our children. In addition to unknowns, our children have become victimizers because of their exposure to so much inappropriate content online.

According to Heidi Olson, Kansas City, child-on-child sexual assault has become staggering in numbers in their pediatric trauma unit at Mercy Hospital. There has been a direct correlation established between a child viewing pornography and becoming a child-on-child sexual assault perpetrator. In fact, according to Finkelhor (et al 2014), a large research study showed that anywhere from one third to half of all perpetrators are juveniles.

In her recently published book, “The Internet: Are Children In Charge?”, Charlene Doak-Gebauer impresses upon everyone globally – “catching up to the digital age is a necessity for the sake of our children, in every country of the world”. The addition of Digital Supervision to our already excellent traditional parenting skills, will enhance our child protection abilities.

Through research, Doak-Gebauer has found that exposure to our children of pornography and other inappropriate content online, is becoming a very real threat to the health of children – some addicted to pornography; some unknowingly producing and distributing child pornography; some performing sexual assaults on other children; some having erectile dysfunction as male teens caused by porn addiction; some planning suicides online; some bullying and threatening peers online; some planning gang attacks online; some planning violent acts to public safety online, and more.

Digital Supervision is written as a proactive approach to online child safety. Doak-Gebauer explains, “We cannot depend on ISP’s, police, governments, social media managers and others to protect our children online. We must supervise our children while they are on digital devices in our homes and schools”.

Too often, people have said “these kids have to make better choices online!!”. Groups go into schools trying to teach children to make better decisions while on digital devices. Doak-Gebauer says children are being given too much ownership for their decisions, particularly online. An eight-year old has little choice as to what to have for dinner, and yet they are supposed to make the right choices while communicating online. They lack the life skills and maturity to do so effectively.

Laws can change in countries, but without method, parents are at a loss. There are age-appropriate design codes in place in Britain. Unfortunately, there can be gaps in the codes. Doak-Gebauer warns that children can find the gaps and still view inappropriate material. Digital Supervision provides a technology/humanity bond for child protection. Too often, Doak-Gebauer cautions that hardware filters, design codes, and software blocking provide a false sense of security for parents.
